Kevin G. Horbatiuk is a member of the firm. Mr. Horbatiuk received his B.A. in history summa cum laude in 1978 from Fordham University and his J.D. from Fordham Law School in 1981. He is licensed to practice in New York and is admitted to the United States District Court for the Southern, Eastern, Western and Northern Districts of New York, the Second Circuit Court of Appeals and the United States Supreme Court.

Mr. Horbatiuk’s practice focuses on defending claims for benefits under ERISA group insurance plans and property and casualty defense work.  He is counsel in New York State for CIGNA Corporation, Hartford Life Insurance Company as well as various self-funded Employer Benefit Plans.  In addition, he is on the approved panel of outside counsel for ACE-USA, JP Morgan Chase, Target Corporation, and North Sea Insurance.  He has been retained to represent numerous national self-insured accounts in personal injury, property damage lawsuits and trucking accident cases.

He is a member of the New York State Trial Lawyers Association, the Defense Research Institute’s “Life, Health and Disability Litigation Committee”, the Torts Trial and Insurance Practice Section of the American Bar Association, the New York County Lawyers Association and the Catholic Lawyers Guild.  He is a regular contributor to the DRI Committee Newsletter. 

Prior to joining the firm in 2001, Mr. Horbatiuk was associated with Harvey, Pennington, Cabot, Griffith & Renneisen, where he supervised that firm’s life, health and disability claims litigation unit in its New York City office and represented numerous self-insured entities in high exposure personal injury lawsuits.  He became a recognized expert in claims litigation under ERISA and was involved in many of the significant Second Circuit life and disability cases.

Mr. Horbatiuk also served as Senior Trial Counsel in the New York City Field Litigation Office of CIGNA P & C Companies, initially known as the Law Offices of Joseph W. Conklin and then Robin Rome Goldfarb and Lloyd.

Mr. Horbatiuk was a pivotal member of CIGNA’s in-house counsel staff for 13 years.  He handled state and federal court trials on behalf of CIGNA’s life, health and disability insurance companies.  In addition, he litigated numerous high exposure construction, transportation and products liability cases in Kings and Bronx Counties.
