RKT Wins Summary Judgment Based on
Lack of "Serious Injury" in Automobile Case
RKT Attorney David Gould won Summary Judgment and dismissal of the plaintiff's complaint before Justice Sallie Manzanet-Daniels in the Supreme Court Bronx County in the case of Rerrie v. Harlem Group, Inc. et al., Index Number 17940-2006.The plaintiff, a 34-year old Nursing Assistant claimed she was injured while she was a passenger in a two car collision. She alleged a disc herniation at C5-6, disc bulge at L4-5 and cuts to the left shin. She claimed to be confined to her bed and home for 2 months following the accident.The court dismissed the plaintiff's complaint under §5102(d) of the Insurance Law as the plaintiff nor her treating physician provided a reasonable explanation for a 3 year cessation in treatment. |
