Complex Tort Litigation: (Asbestos, Lead Paint, Mold, etc.) RK&T is actively involved in several areas of complex tort litigation, including the defense of lead paint, asbestos, mold exposure, and other environmental claims. We currently provide lead litigation defense services to Pioneer Insurance Company, the State Liquidation Bureau, American International Group, Brownstone Insurance Company and the Hartford Insurance Company. We provide asbestos defense services to Riverbay Corporation (Co-op City), and mold litigation and environmental defense services to the Hartford Insurance Company. Alan Russo, Esq. heads up this area of practice. Mr. Russo has over 15 years experience defending complex environmental related claims. Fern Flomenhaft, Esq. and Francesca Sabbatino, Esq. are also members of this group each with over 15 years experience defending lead paint cases. Products Liability: RK&T has agressively defended and won products liability actions on behalf of our corporate clients. Our current products liability clients include Combe Inc., a major cosmetic manufacturer of well known products such as Grecian Formula, Brylcreem, Just For Men, Cepacol Mouthwash and Odor-Eaters. Some of the other manufacturers represented by our attorneys over the years have included, Zenith Corporation, American Cyanamide, Springs Industries, Trinova Corporation, Dresser Rand Corporation, Ingersoll- Rand, Ciba-Geigy and the New York Blood Center. General Property & Casualty Liability Claims: (Premises, Auto, etc.) RK&T provides varied general liability, including premises liability, defense services to several major insurance carriers including The Hartford, Brownstone Insurance, American International Group, Middlesex Mutual Insurance, Riverbay Corporation, Safeco Insurance, Ace USA, RLI, ESIS and Farmers Insurance. RK&T also serves as trial counsel to American Transit Insurance Company, the largest insurer of licensed taxi and livery vehicles in the State of New York. Our firm has taken an aggressive stand against fraudulent claims. We represent several major insurers, including The Hartford and Kemper, in connection with special programs designed to identify and vigorously defend against suspected fraudulent auto liability claims. Our attorneys have extensive experience defending a wide array of general liability property and casualty claims and participate in all aspects of general liability defense work from inception to trial. Construction Accident Claims: We handle all aspects of the defense of construction accident and labor law cases including liability defense for owners and contractors, the enforcement and defense of contractual indemnity claims, appeals and related insurance coverage work. Our representative clients in this area are Safeco Insurance, The Hartford, Arch Insurance Group, North Sea Insurance and ACE USA. Alan Russo, Esq. heads up this practice group. First-Party Benefits Claims/Examinations Under Oath: RK&T has been selected by the Hartford Insurance Company and Kemper Insurance to conduct Examinations Under Oath in suspected auto fraud cases involving both no fault and related auto first party benefit fraud investigations. We also handle Examinations Under Oath in connection with property loss fraud investigations in the New York Metro Area for The Hartford. Alan Russo, Esq. and Francesca Sabbatino, Esq. lead this unit. Insurance Coverage and Appeals RK&T has an active Coverage and Appellate practice group which services our entire client base. Additionally, this group provides coverage opinions, drafts disclaimer letters and represents our clients in the prosecution and defense of declaratory judgment actions. Health, Disability and Life Litigation:
RK&T serves as New York litigation counsel for Cigna Health Care, one of the largest health insurers in the country. We represent Cigna throughout the state of New York in both federal and state court and in all the arbitration forums. We also offer coverage opinions and are active in advising our health, disability and life clients on pre-litigation matters.
