RKT Won a Summary Judgment Liability Motion

RKT Attorney David Gould won a Summary Judgment liability on behalf of Yajaira Reyes in the case of Martinez v. Diaz, Tomas & Lepido Corp. and Yajaira Reyes, before Justice Nelson Roman in the Supreme Court Bronx County, index number 30395/08.

This matter arose out of a two-car collision that took place on November 30, 2005, at the entrance ramp to the Major Deegan Expressway and Van Cortland Park South in the Bronx.  Co-defendant Alejandro Diaz was attempting to merge onto the entrance ramp of the Major Deegan Expressway and struck Yajaira Reye's vehicle in the rear.  Reyes was also trying to merge onto the Expressway.

Justice Roman held that co-defendant Diaz was negligent as a matter of law and dismissed the case as against defendant Reyes.
