RKT Attorney John Corring recently obtained an impressive string of five consecutive defense verdicts. His exceptional preparedness and convincing arguments were bolstered by decisive evidence that proved to undermine the plaintiff's claims. Whether he was exemplifying the plaintiff's failure to meet the serious injury threshold or convincing juries of no negligence on the part of the defense, Corring delivered exceptional results. In the Bronx County Supreme Court, John obtained a defense verdict for the case of Phillips v. Fulgencio. Plaintiff was the passenger in a vehicle that was rear ended by RKT’s client’s taxi. Summary judgment was granted on the basis of liability against our client’s taxi. While the plaintiff sustained lumbar and cervical disc herniations, the jury agreed with Corring’s defense, deciding that the plaintiff did not sustain a serious injury. John obtained a defense verdict on the case of Kalinosky v. Azam. Plaintiff was a bicyclist in the bike lane in Central Park West in Manhattan. Our client, the driver of a yellow taxi, pulled over to let a passenger out. The passenger opened the taxi’s door into the bike lane and the plaintiff hit the door. Plaintiff sustained head trauma with a subdural hematoma and residual brain damage/neurological deficits. In addition, the plaintiff sustained damage to her teeth requiring extensive dental work. The Jury agreed with John’s arguments and returned a verdict for our client finding that there was no negligence on the part of the taxi driver. John’s successful defense verdict string continued when Corring obtained a defense verdict for the case of DeJesus v. Rodriguez. In this case the plaintiff was driving her vehicle in a shopping mall parking lot and alleged that RKT’s client while pulling out of a parking space hit the plaintiff’s vehicle. Our client alleged that the plaintiff was speeding in the parking lot and struck his car in the side. The Judge agreed with John’s arguments and determined that RKT’s client was not negligent. In Kerr v. Ghebreab, John obtained another defense verdict. In this case the plaintiff was a passenger in our client’s taxi which struck another vehicle in the rear. As a result, the plaintiff allegedly sustained a meniscus tear to the right knee requiring surgery. The defense radiologist testified that the knee MRI showed degenerative wear and tear that clearly pre-dated the accident. The jury responded to the defense radiologist’s testimony and agreeing with Corring’s arguments found that the plaintiff did not sustain a serious injury as a result of this accident. In the case of Caballero v. DeJesus the plaintiff was a passenger in our client’s taxi which struck a stopped vehicle in the rear. The Court directed a verdict against us on liability. Plaintiff sustained injuries to both knees requiring bilateral knee replacement surgery. Although plaintiff denied any history of arthritis, the hospital record had notations regarding a history of osteoarthritis. Our expert radiologist testified that the MRIs of the knees showed only degenerative arthritis and no injuries from acute trauma. The jury found that our client’s negligence was not a substantial factor in causing the plaintiff’s injuries. A defense verdict was obtained. |
