Motion for Summary Judgment Granted in Slip-and-Fall Case

In the case of Acevedo v. 1221 Holdings Inc plaintiff claimed she slipped and fell on a large puddle of water in the lobby of our client’s building. Plaintiff alleged there were no inclement weather mats in the area where she fell and the defendant failed to mop the wet floor, which contained a large puddle in which two other people had fallen at the same time as the plaintiff.

 Our client argued that it was still raining when the incident occurred and that there was no requirement that our client cover all floors in the building’s lobby. Further, our client stated that the plaintiff failed to prove notice in that she could not adequately describe the water condition nor did she know how long it existed in that location.

 After oral argument in front of Judge Lehner, RKT Attorney Marie Castronuovo’s motion for Summary Judgment was granted. The Judge agreed that our client was not required to place mats throughout the entire lobby nor were we required to continually map the floor.
