Vendor Providing Case Management Services Owed No Duty to Plaintiff In Gorelik v. Intracorp the plaintiff sued Intracorp, the entity which was providing case management services to her Worker's Compensation carrier during her pending claim. Intracorp's specific duties included acquiring copies of the plaintiff's medical records for ultimate review by a physician retained by the Worker's Compensation carrier to determine her entitlement to benefits. She initially received the benefits and Intracorp continued to forward medical and treatment records. Ultimately her Worker's Compensation claim was denied based on the newly acquired medical documentation. Plaintiff sued Intracorp in the Civil Court of the City of New York. At the trial in front of Civil Court Judge Margaret A. Chan, RKT Attorney Matthew Mazzola argued that the plaintiff had no viable legal claim against Intracorp and that the plaintiff's proper avenue of redress was in the Worker's Compensation Board. Judge Chen agreed with Matthew's arguments and issued a decision which held that Intracorp had no duty to the plaintiff. Accordingly she dismissed the plaintiff's complaint. |
